Qualified electronic ledger
The eIDAS trust service for ordered records: a qualified ledger presumes unique chronological ordering and integrity, with no technology prescribed.
The other trust service eIDAS added in 2024: a service that records data in a sequence, so that both the origin of each record and the order of the records can be relied upon. Article 45k gives the qualified version its weight: records in a qualified electronic ledger enjoy the presumption of their unique and accurate sequential chronological ordering and of their integrity.
Article 45l lists what a qualified ledger must do. It is created and managed by one or more QTSPs; it establishes the origin of the records in it; it ensures their unique sequential chronological ordering; and it records data in such a way that any subsequent change is immediately detectable, keeping integrity over time.
Read those requirements again and notice what is missing: any mention of a technology. The law describes properties, not blockchains. A qualified ledger may be run by a single provider on ordinary infrastructure as long as ordering and detectability are guaranteed, and a distributed ledger without qualified status carries no legal presumption at all. The natural uses are the ones where sequence is the evidence: audit trails, registers of issued attestations, chains of custody. It sits next to rather than instead of a qualified timestamp, which proves that something existed at a point in time, and a qualified archiving service, which keeps documents themselves intact.
